RETURN & WARRANTY POLICY

Instrument Warranty

Activator Methods International, Ltd. guarantees the new I, II, EZ Grip II, ARIV, and EZ Grip IV Activator® adjusting instruments against defects in material and workmanship under normal use for two years from the date on the delivery invoice. This warranty policy includes any instrument that malfunctions or breaks under normal use, but does not include instruments that have been misused, dry fired, dropped, submerged in water, or disassembled. The two-year warranty policy does not include the Activator® V instrument. The Activator® V instrument has a one-year warranty against defects in material and workmanship under normal use from the date on the delivery invoice.

All warranties on replacement instruments revert back to the original purchase date, and no new extended warranties are given with these replacement instruments. Activator Methods warranty applies to new instruments purchased from Activator Methods or an authorized Activator Methods International Ltd. distributor.

The limited warranty described herein shall be in lieu of any other warranty, expressed or implied, including but not limited to any implied warranty or merchantability or fitness for a particular purpose. Activator Methods International, Ltd. makes no other warranties, expressed or implied. Warranty is not transferable.

Cleaning Instructions:

  Activator I, II, and IV (Stainless Steel Cleaning Instruction)

Do clean instruments with mild soap using a soft, clean cloth or microfiber cloth; then thoroughly dry the instrument with a soft, clean cloth or microfiber cloth.

Note: Avoid getting any form of liquid on the inside of the instrument.  

 

Don’t use disinfecting wipes, i.e., Clorox disinfecting wipes or cleaners that contain alcohol, ammonia, or chlorides, all of which can be harmful to stainless steel. Furthermore, do not use steel wool or scrub pads; they may scratch the surface, leaving it vulnerable to moisture.

Customers receiving shipments from AMI should, upon delivery of the order, conduct an inspection to verify the following conditions:

  • The product conforms to the original order (EXAMPLE: correct instrument model)
  • The product is not damaged
  • Products are operable or functional
  • The product count is accurate (EXAMPLE: if the customer orders 4 bags of MT5 tips, the customer should verify that there are 4 bags of MT5 tips in the package)

If a customer does not contact AMI within 14 days of the invoice date for any non-conformance, AMI will deem the shipment as “accepted”.

Activator Methods Shipping and Return Policy & Conditions:

Although certain shipping service options guarantee specific delivery time frames, Activator Methods is not responsible for delays in transit caused by weather, mechanical failures, strikes, natural disasters, local carrier miss-scans, or inaccurate shipping information. Customers are responsible for verifying that all shipping information is correct before submitting an order. Orders shipped via FedEx cannot be delivered to P.O. Box addresses and must be shipped via USPS. All shipping service levels for orders purchased through Activator Methods are shipped without a signature required for release. Packages left at the door of residential and/or commercial destinations are up to the discretion of the individual delivery person of each carrier and are therefore entirely outside of Activator Methods’ control. Activator Methods is not responsible for damaged, lost, or stolen orders during transit or left at the destination. If delivery confirmation is needed for the release of an order at the destination address, a ‘Signature Required’ option is available for an additional fee of $8.00. Please select the “Signature Required” shipping option by selecting add to cart from the products page of the website. If ordering by phone, please mention the “Signature Required” option item to your Customer Service representative.

No returns on all software products.

No returns on used or purchased demonstration items.

No returns are accepted on any personal items including but not limited to:

  • Tips
  • Pad Grips
  • Adjusting Shoes
  • T-shirts
  • Hats

Returns of instruments will be accepted for in-house credit only within 14 days of the invoice date, minus a 20% restocking fee and minus a credit card fee up to 5%, provided the items are in new condition and in the original packaging.  Instruments that are scratched, dented, cracked, broken, dropped, tampered with, or opened will not be accepted and will be returned.  No third-party shipping will be accepted.  Please allow 3 business working days for review of returned items for acceptability.  No cash refunds will be issued.  In-House credit can be used towards the registration fee of future seminars or future product purchases.

Please allow 10-14 business days for all warranty instrument replacements.

Shipping and Handling fees are non-refundable.

Duties and Taxes resulting from shipping internationally

All orders placed with Activator Methods International, Ltd. Are shipped from the United States.  These orders are subject to any and all duties and taxes deemed appropriate by the local customs authorities of the named recipient’s destination country and are not included in the shipping costs reflected on the order.  These duties and taxes are the sole responsibility of the person or persons placing the original order.  Activator Methods International, Ltd. makes no claim of responsibility for the payment of any such duties and taxes imposed by any country as a result of the purchaser’s order.  These fees are the sole responsibility of the named recipient on the order.

Duties and Taxes resulting from shipping within the US

Activator Methods complies with all applicable tax requirements. Activator Methods collects sales taxes on physical products shipped to Alabama, Arizona, and Minnesota.

The seller has collected the simplified sellers’ use tax on taxable transactions delivered into Alabama and the tax will be remitted on the customer’s behalf to the Alabama Department of Revenue.

 Important return conditions:

  • A Return Merchandise Authorization (RMA) number must be obtained from Customer Service prior to returning any merchandise. When phoning or emailing for an authorization number to return merchandise, please contact the Customer Service department  and be prepared to give:
  • Your name and/or business name as it appears on the invoice or packing slip.
  • Your telephone number and a person to contact.
  • The reason for the return.
  • Device serial number
  • Invoice number

Activator Institute Policies

Prior to Enrollment: Customers seeking to enroll in any course that offers CE credits must independently verify whether the credits provided by the course are approved in their respective state, country, or region before enrollment. It is the customer’s responsibility to ensure that the course meets the specific requirements set forth by their local licensing board, regulatory authority, or professional association.

Non-Compliance: Failure to verify whether the credits provided by the course are approved in their respective state, country, or region before enrollment. This may result in the denial of CE credit recognition and could impact the customer’s professional development and licensure status.

Non-Transferability of Responsibility: The responsibility for verifying the approval status of CE credits lies solely with the customer. The company or course provider shall not be held liable for any consequences arising from the customer’s failure to verify credit acceptance.

All VT courses are non-refundable. 

Time Tracking: CE hours will be granted for the number of hours a customer is in the online course. The course platform includes an automated time-tracking mechanism to record the customer’s engagement in the course accurately. The system will capture the start time and end time of each session, allowing for precise measurement of the total time spent in the course.




Premium Web Page Subscription Terms and Conditions

Pricing: Prices reflect listing on the Activator.com website. Subscription pricing is based on a July 1 to June 30 billing cycle and all subscriptions received after July 1 will be pro-rated. The prices are good for one year.

Cancellation: All cancellations must be received by Activator Methods International in writing at least 30 days prior to the renewal date. Should prices change, a notification will be mailed to credit cardholders 60 days before renewal. New listings on Activator.com will be available within 15 business days from the date of this agreement.

External Links: External website links from your Activator.com page are not permitted.

Web Address & Third Party Advertising: From time to time, new technologies may be added to the Activator website that may require updates to the customer’s web address. Should this occur, Activator Methods will make every effort possible to alert the customer. It is, however, the customer’s responsibility to update any third-party web advertising services of such changes should this occur. Updating third-party online advertising services including, but not limited to any type of pay­ per-click (PPC) service is strictly the responsibility of the customer.

Rating Status: Acceptance in the Activator Methods Web Marketing Program is contingent on the chiropractor maintaining his or her Proficiency or Advanced Proficiency Ratings. Chiropractors who lose their Proficiency or Advanced Proficiency Rating will no longer be eligible for listing on Activator.com and their listings will be deleted. No refunds will be given. Should the chiropractor regain his or her Proficiency or Advanced Proficiency Rating before the term of this contract is complete, the listing will be re-established and will automatically renew on the anniversary date of this agreement. Time lost will NOT be prorated.

Your privacy is very important to all of us at Activator Methods International, Ltd., an Arizona corporation (“Company”, “we”, “our”, or “us”). We have established this privacy policy (“Privacy Policy”) to explain to you how your personal information is protected, collected, and used when you use the Company website (the “Site”). Personal information is information about you that is personally identifiable, such as your name, email address, and other information, that is not otherwise publicly available (“Personal Information”).

“Sensitive Information” is information that meets the definition of Personal Information and also concerns specific health conditions or treatments a certain identifiable person has, or information which could be used to impersonate someone (such as a social security number, financial account data, government identification information, or other data used for individual authentication).

Activator does not collect Sensitive Information except in limited circumstances where it is necessary for business purposes.  You agree not to submit Sensitive Information on this website except as requested by Activator.  Activator will only request Sensitive Information as required to complete a transaction or identify you individually for registration, certification, or other mutually beneficial business purposes.  Activator will endeavor to protect your Sensitive Information and will never sell it or give it to a third party for their use.  Your Sensitive Information will be retained only as required for business and recordkeeping purposes.  Sensitive Information will be destroyed when it is no longer reasonably needed in Activator’s judgment.

  1. Use of Your Personal Information

We use your Personal Information, and other information we obtain from your current and past activities on the Site to: present our Site and its contents to you; resolve disputes; troubleshoot problems; measure consumer interest in our products and services; inform you about online and offline offers, products, services, and updates; customize your experience on our Site; detect and protect us against error, fraud and other criminal activity; to carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection; enforce our Terms of Use; and as otherwise described to you at the time of collection. We may compare and review your Personal Information for errors, omissions, and accuracy.

You agree that we may use your Personal Information, including your email address, to improve our marketing and promotional efforts, to analyze Site usage, and to customize the Site’s content, layout, and services. These uses improve our Site and better tailor it to meet your needs, so as to provide you with a smooth, efficient, safe, and customized experience while using the Site.

  1. Communications from Company

If you opt-in to receive our electronic newsletter, we may occasionally send you information on products, services, special deals, and promotions. Out of respect for your privacy, we provide you a way to unsubscribe from each of these communications. If you no longer wish to receive our promotional communications, you may opt-out of receiving them by following the instructions included in each such communication or by contacting us.

We will send you strictly service-related announcements on rare occasions when it is necessary to do so. For instance, if access to our Site is temporarily suspended for maintenance, we might send you an email. Generally, you may not opt-out of these communications, which are not promotional in nature. If you do not wish to receive them, please do not submit your Personal Information through our Site.

  • Legal Requests: The Company cooperates with law enforcement inquiries, as well as other third parties to enforce laws, such as: intellectual property rights, fraud and other rights, to help protect you, other users, and Company from bad actors. Therefore, in response to a verified request by law enforcement or other government officials relating to a criminal investigation or alleged illegal activity, we can (and you authorize us to) disclose your name, city, state, telephone number, email address, username history, and fraud complaints without a subpoena. Due to the existing regulatory environment, we cannot ensure that all of your private communications and other Personal Information will never be disclosed in ways not otherwise described in this Privacy Policy. By way of example (without limiting the foregoing), we may be forced to disclose Personal Information, including your email address, to the government or third parties under certain circumstances, third parties may unlawfully intercept or access transmissions or private communications, or users may abuse or misuse your Personal Information that they collect from Company. Therefore, although we use industry standard practices to protect your privacy, we do not promise, and you should neither rely upon nor expect, that your Personal Information or private communications will always remain private.

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

We strive to provide you with choices regarding the Personal Information you provide to us. We have created mechanisms to provide you with the following control over your information:

If you disable or refuse cookies, please note that some parts of this Site may then be inaccessible or not function properly.

  • Promotional Offers from the Company. If you do not wish to have your email address/contact information used by us to promote our own or third parties’ products or services, you can opt-out by sending us an email stating your request to Privacy@Activator.com. If we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions. This opt out does not apply to information provided to us as a result of a product purchase, warranty registration, product service experience, or other transactions.
  • Targeted Advertising. As a rule, we do not share, sell, rent, or otherwise disseminate your Personal Information to third parties.
  1. Rights to Access and Control Your Personal Information

Any personal data that we collect is based upon your consent as detailed in this Privacy Policy.  You have many choices concerning the collection, use, and sharing of your data, including the ability to:

  • Delete Data: You may request that we delete your Personal Information. Please note that we cannot delete your Personal Information except by also deleting your user account.
  • Change or Correct Data: You can also ask us to change, update, or fix your data in certain cases, particularly if it’s inaccurate. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.
  • Object to, or Limit or Restrict, Use of Data: You may request that we do not use your Personal Information, but keep in mind that this will terminate our ability to provide any Service(s) to you.
  • Right to Access and/or Take Your Data: You can ask us for a copy of your Personal Information.

  1. Your California Privacy Rights

California Civil Code Section § 1798.83 permits users of our Site that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.   1. Security

We follow generally accepted industry standards to protect Personal Information, including your email address, submitted to us, both during transmission and once we receive it. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.  Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Site.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Site, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

  1. Changes in this Privacy Statement

If we decide to change our Privacy Policy, we will post those changes to this Privacy Policy and other places we deem appropriate so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. We reserve the right to modify this Privacy Policy at any time, so please review it frequently.

  1. Children Under the Age of 13  

We do not collect any Personal Information from children under the age of 18. If you believe that a child has provided us with Personal Information without the consent of his or her parent or guardian, please contact us at Privacy@Activator.com. If we become aware that a child under age 18 has provided us with Personal Information, we will delete it.
